GENERAL BOOKING CONDITIONS
These General Booking Conditions (hereinafter General Conditions) shall regulate the commercial relationship that arises between SASTRE CIFRE SL and the user or customer for the contracting made through the forms that SASTRE CIFRE SL makes available on its www.hotel-miramar.net. Booking through the websites of SASTRE CIFRE SL shall imply the express acceptance, by the customer or user of the pages, of these conditions, as well as the conditions of use established for the user’s browsing of the pages owned by SASTRE CIFRE SL.
These conditions shall be applicable without prejudice to the application of the legal regulations on the matter that may be applicable in each case. The General Conditions regulate the distance selling relationship between SASTRE CIFRE SL and the user or customer, in accordance with the legal stipulations, in particular, Law 7/1998, of 13 April, on General Conditions, Law 3/2014, of 27 March, which modifies the revised text of the General Law for the Defence of Consumers and Users, Organic Law 15/1999, of 13 December, on the Protection of Personal Data, Law 7/1996, of 15 January, on the Regulation of Retail Trade, and Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce. SASTRE CIFRE SL reserves the right to make any modifications it deems appropriate, without prior notice, in the General Conditions. Such modifications may be made, through its websites, by any legally admissible means and shall be binding for as long as they are published on the website and until they are validly modified by subsequent modifications. However, SASTRE CIFRE SL reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Conditions when it deems appropriate, announcing them in due time and form. Information prior to booking SASTRE CIFRE SL informs that the booking procedure through its web pages is detailed in the corresponding section for the formalization of the booking. Likewise, SASTRE CIFRE SL informs that the user can access the conditions of use available on the same website.
By booking with SASTRE CIFRE SL through its website, the user or client expressly declares to know, understand and accept these conditions of use and the General Conditions. Likewise, the user declares to be of legal age and to have the necessary legal capacity to access the websites of SASTRE CIFRE SL and to contract through them. The user is responsible for treating the identity and password obtained when registering as a customer confidentially and responsibly, and may not transfer them to anyone else. Once the booking has been made, the user will see the booking confirmation on the screen, which can be printed as proof of the booking made. The booking confirmation and the booking receipt (printout made by the user) will not be valid as an invoice.
BOOKING OFFER AND PRICE REFERENCE
In compliance with current legislation and, in particular, with Law 34/2002 on information society services and electronic commerce, SASTRE CIFRE SL offers information on all possible reservations, their characteristics and prices in the corresponding section for formalizing the reservation. However, SASTRE CIFRE SL reserves the right to withdraw, replace or change the offers offered to its customers through its website, by simply changing their content. In this way, the products and/or services offered at any given time by the SASTRE CIFRE SL website shall be governed by the General Conditions in force in each case. Likewise, the company shall have the right to cease to offer, without prior notice and at any time, access to the aforementioned products and/or services.
OPERATION OF THE RESERVATION OF ACCOMMODATION
Each possible reservation offered will indicate its price and whether it includes VAT or any other applicable tax. The prices indicated on the screen will be those in force at any given time, unless there is a typographical error. When the price is different for the aforementioned reason, SASTRE CIFRE SL will inform the customer, via e-mail, before proceeding to charge the reservation.
The availability of the offers provided by SASTRE CIFRE SL through its website may vary depending on customer demand. Although SASTRE CIFRE SL updates its database periodically, the reservation requested by the customer may be full at that time. In this case, SASTRE CIFRE SL will send an e-mail to the customer informing him/her of the impossibility of the availability of the offer.
SASTRE CIFRE SL requests the details of a credit card, the holder of the reservation, in order to guarantee the effectiveness of the reservation. We remind you that the establishment will charge your credit card when you make this reservation. The establishment reserves the right to check the validity of the credit card before the arrival of the client. The invoice corresponding to the reservation will be paid directly at the establishment, either in cash, by credit card or by any other method accepted by the establishment.
CANCELLATION OF THE RESERVATION
– Cancellation up to 30 days before the arrival date: 100% of the deposit is returned.
– Cancellation between 29 days of the arrival date and the arrival date itself: the deposit will NOT be returned.
The sustainable tourism tax came into force in the Balearic Islands on July 1st, 2016. Its purpose is to compensate for the ecological footprint that tourism leaves on the islands, as well as for the improvement of the tourist destination.
The amounts are:
4 star hotels: 3 euros + VAT per person per day.
– There is a bonus of 75% of the total tax from November 1st to April 30th.
– There is a 50% discount from the ninth and following days. Only for stays of more than 8 days in the same establishment.
– Children under 16 years of age are exempt from paying the ecotax.
CANCELLATION / MODIFICATION OF THE AIRPORT SHUTTLE
After 24 hours prior to the service, 100% of the costs will be charged in the event of cancellation (except in cases of force majeure, illness, always with a medical certificate).
OPERATION OF THE GREEN FEES RESERVATION FOR GOLF PRACTICE
On the day of play, players must present a Hotel voucher at the reception of the Alcanada Golf Club.
All reservations and cancellations must be made by e-mail: firstname.lastname@example.org or by fax: +34 – 971 89 75 78. Aucanada SA will confirm the reservation or cancellation by the same means. Clients have to present themselves with a valid voucher at the club.
Cancellation of booking
Groups of less than 7 players: Cancellations are accepted up to 48 hours before the booked departure free of charge. From 48 hours before departure, 50% of the total amount will be charged. Cancellations less than 24 hours before departure or in case of “no show”, 100% of the green fees will be charged. Groups between 8 and 12 players: 14 days before the booked day, cancellations are accepted free of charge. Between 14 days before departure and 24 hours before, 50% of the total amount of the reservation will be charged. In case of cancellations with less than 24 hours notice or in case of “no show” Aucanada SA will charge 100% of the total green fees. Groups larger than 12 players: Please contact the Director of Aucanada SA for further details regarding the cancellation policy. All players must hold a valid handicap card or certificate (33 for men/ 35 for women) which must be presented at the reception of the Alcanada Golf Club and must comply with the rules and etiquette of the Royal and Ancient Golf Club of St. Andrews and the Royal Spanish Golf Federation as well as the local rules of the Alcanada Golf Club. Players who during their round of golf have to be advised that their game is below the standard required on our course, in the opinion of the Director of Golf, may be asked to leave the course and the TT.OO. will waive in this case the right to claim any refund. Players must pass through reception 30 minutes before their tee time and must be ready on tee 1 at least 10 minutes before their tee time. The Alcanada Golf Club reserves the right to add players up to a maximum of 4 players per tee time. The playing time for a 4-person tee time for 18 holes is 4.5 hours.
In accordance with the provisions of Organic Law 15/1999 on the Protection of Personal Data, SASTRE CIFRE SL informs users of its websites that the personal data collected by the company through the forms on its pages will be included in a file under the responsibility of SASTRE CIFRE SL, in order to facilitate, expedite and fulfil the commitments established between the two parties. Likewise, SASTRE CIFRE SL informs of the possibility of exercising the rights of access, rectification, cancellation and opposition by writing to the address PASSEIG ANGLADA CAMARASSA 39 07470, PORT DE POLLENÇA (ILLES BALEARS). As long as you do not tell us otherwise, we will understand that your data has not been modified, that you agree to notify us of any change and that we have your consent to answer as many queries as you deem appropriate and to send you the information requested.
APPLICABLE LEGISLATION AND JURISDICTION
Likewise, SASTRE CIFRE SL reserves the right to bring any civil or criminal action it deems appropriate for the improper use of its website and contents or for any breach of these conditions. The relationship between the user and the provider shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise, the parties may submit their conflicts to arbitration or go to ordinary jurisdiction in accordance with the regulations on jurisdiction and competence in this respect.
